These Terms of Use (“Terms”) govern your access to and use of the website at horsehealthhq.com (“Site”) and our mobile application (“App”) (collectively, “Services”) operated by Foundation for Horse Health HQ. Please read these Terms carefully.

1) Acceptance of Terms

By accessing or using the Services, you agree to be legally bound by these Terms and our Privacy Policy available at horsehealthhq.com/privacy-policy/. If you do not agree, please discontinue use of the Services immediately.

By using our Services, you confirm you are at least 13 years of age (or 16 in Quebec) and have the legal capacity to enter into this agreement.

2) Purpose of This Website

The Services provide:

Free educational training resources for horse owners and veterinarians

Educational materials created and reviewed by licensed equine veterinarians

A mobile application for accessing training content, resources, and community programs

Opportunities to donate, engage in programs, and support equine welfare initiatives

Crisis response guidance and equine welfare education

All content is for informational and educational purposes only and is not a substitute for professional veterinary advice, diagnosis, or treatment.

3) No Veterinary-Client Relationship

Use of the Services does not establish a veterinarian-client-patient relationship (VCPR). No content constitutes professional veterinary advice. Always consult a licensed equine veterinarian for personalized guidance.

Horse Health HQ, its staff, officers, volunteers, and content contributors are not liable for veterinary decisions made based on information obtained through our Services.

4) User Responsibilities

You agree to:

Use the Services lawfully and in compliance with all applicable Canadian federal and provincial laws

Not interfere with or disrupt the integrity or security of the Services

Not attempt to gain unauthorized access to any part of the Services or user accounts

Not misuse, reproduce, or redistribute content without prior written permission

Not upload or transmit viruses, malware, or any other harmful code

Not collect or store personal data about other users without their explicit consent

Not send unsolicited commercial electronic messages in violation of Canada’s Anti-Spam Legislation (CASL)

Violation of these responsibilities may result in immediate termination of your access.

5) Intellectual Property

All content — including text, graphics, videos, training materials, logos, branding, and downloadable materials — is owned by Foundation for Horse Health HQ or used with permission, and is protected under the Copyright Act (Canada) and applicable international intellectual property laws.

5.1) Permitted Uses

View, share, or download materials for personal, educational, or non-commercial use

Reference or cite our content with appropriate attribution to Horse Health HQ

Share links to our content on social media or other platforms

5.2) Prohibited Uses

6) User Submissions

If you submit comments, questions, feedback, or messages through the Services (“User Content”), you grant Horse Health HQ a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and distribute that content for operating and improving our programs.

By submitting User Content, you represent that:

You own or have the necessary rights to submit the content

Your submission does not infringe any third-party intellectual property, privacy, or publicity rights

Your submission does not contain unlawful, defamatory, harassing, or harmful content

We reserve the right to remove any submission at our sole discretion without notice.

7) Donations & Payments

When making a donation through the Services, you agree that:

You will provide accurate, complete, and current payment and billing information

All payments are processed through secure, PCI-compliant third-party providers — we do not store payment card details

Donations support our nonprofit educational mission and are generally non-refundable

Refunds may be issued at our sole discretion or as required by applicable Canadian federal or provincial nonprofit laws

Official donation receipts will be issued for qualifying donations in accordance with the Income Tax Act (Canada) where applicable

8) Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, HORSE HEALTH HQ EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE:

ACCURACY OR COMPLETENESS OF INFORMATION PROVIDED THROUGH THE SERVICES

CONTINUOUS, UNINTERRUPTED, OR ERROR-FREE WEBSITE OR APP ACCESS

THAT RESOURCES WILL MEET YOUR INDIVIDUAL NEEDS OR EXPECTATIONS

THAT DEFECTS OR ERRORS WILL BE CORRECTED

ALL EDUCATIONAL CONTENT IS PROVIDED BY PRACTICING EQUINE VETERINARIANS AND REFLECTS BEST AVAILABLE KNOWLEDGE AS OF THE DATE OF PUBLICATION. IT SHOULD NOT BE USED AS A SUBSTITUTE FOR DIRECT VETERINARY GUIDANCE.

9) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, FOUNDATION FOR HORSE HEALTH HQ, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR:

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES

INJURY, LOSS, OR DAMAGES ARISING FROM USE OF THE SERVICES OR RELIANCE ON EDUCATIONAL CONTENT

ACTIONS TAKEN BY YOU OR ANY THIRD PARTY BASED ON CONTENT ACCESSED THROUGH THE SERVICES

LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES

WEBSITE OR APP DOWNTIME, DATA LOSS, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO HORSE HEALTH HQ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).

YOU ASSUME FULL RESPONSIBILITY FOR APPLYING ANY INFORMATION SHARED THROUGH THE SERVICES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE CANADIAN CONSUMER PROTECTION LEGISLATION.

10) Third-Party Links

Our Site and App may include links to third-party websites and services. We do not control, endorse, or assume responsibility for any third-party content, privacy practices, or services. Accessing third-party links is entirely at your own risk.

11) Termination of Access

We reserve the right to:

Suspend or terminate your access at any time, with or without cause and with or without notice

Modify or discontinue any Site or App features at our sole discretion

Restrict or block access in cases of misuse, violation of these Terms, or malicious activity

Upon termination, your right to use the Services immediately ceases. Provisions relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

12) Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date and may notify registered users by email or in-app notice. Continued use after changes constitutes acceptance.

13) Governing Law

These Terms are governed by and construed in accordance with the laws of Canada and the province in which Foundation for Horse Health HQ is incorporated, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any disputes that cannot be resolved informally shall be submitted to binding arbitration administered by the ADR Institute of Canada under its National Arbitration Rules. The arbitrator’s decision shall be final and binding. Either party may seek injunctive or equitable relief from a court of competent jurisdiction.
